1. Acceptance of Terms

By accessing or using Datovu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Datovu provides a platform for searching, injecting, and indexing data, and deploying it as a monetizable REST API. The Service includes agentic web search, data injection, semantic indexing, API hosting, and billing/monetization features.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current, and complete information.

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any laws
Scrape or access websites that prohibit automated access in their terms of service or robots.txt
Upload or index content that infringes on intellectual property rights
Use the Service to distribute malware, spam, or harmful content
Attempt to circumvent rate limits, billing mechanisms, or security measures
Resell the Service itself (as opposed to APIs built on the Service) without written authorization
Use the Service to build competitive products or services

5. Data Ownership

You retain all ownership rights to data you inject into the Service. Datovu claims no intellectual property rights over your data. You grant us the necessary license to process, store, and index your data to provide the Service.

6. Billing and Payments

Subscription fees are billed monthly in advance. Usage-based charges (overages) are billed at the end of each billing cycle. All payments are processed through Stripe.

Plans may be upgraded at any time (prorated charge applies)
Downgrades take effect at the start of the next billing period
Refunds are provided at our discretion for Service outages or billing errors
Failure to pay may result in suspension or termination of access

7. Publisher Terms

If you use Datovu to publish and sell API access to third parties ("Publisher" segment):

You are responsible for setting your own pricing and terms with your customers
Datovu collects a platform commission as disclosed on the pricing page
Payment processing fees (2.9% + $0.30) are deducted from each transaction
Payouts are made on a regular schedule through our payment provider
You are responsible for customer support and refunds for your published APIs
Datovu reserves the right to remove APIs that violate these terms or applicable law

8. Service Level and Availability

We strive for 99.9% uptime for published APIs. Scheduled maintenance will be announced in advance. The Service is provided "as is" without warranties of uninterrupted availability.

9. Limitation of Liability

Datovu shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the fees you paid in the 12 months preceding the claim.

10. Termination

Either party may terminate the agreement at any time. Upon termination, your data will be retained for 30 days before deletion. We may terminate or suspend access immediately for violations of these terms.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.
